Privacy Policy

1. Data Controller. CodeFlowWorks, located at Rua da Sofia 150, 3000-389 Coimbra, Portugal, acts as the data controller for all personal data collected through this website and its services.

2. Data Collection. We collect personal information solely for the purpose of executing requested services. This includes names, email addresses, phone numbers, project details, and billing information submitted through our contact forms or during project onboarding.

3. Purpose of Processing. Your data is processed to: (a) respond to inquiries and provide project proposals, (b) execute and deliver contracted web design services, (c) manage billing and payment processing, and (d) comply with legal obligations under Portuguese and EU law.

4. Legal Basis. Processing is based on: (a) your explicit consent when submitting a form, (b) performance of a contract when engaging our services, and (c) legitimate interest in improving our service offerings.

5. Data Retention. Personal data is retained for the duration of the business relationship and up to 5 years after the last project milestone, in accordance with Portuguese tax and commercial record-keeping requirements.

6. Security Measures. We implement industry-standard encryption (TLS 1.3), access controls, regular security audits, and secure data storage practices to protect your information against unauthorized access, alteration, or destruction.

7. Third-Party Sharing. We do not sell or share personal data with third parties except: (a) payment processors strictly for transaction completion, (b) hosting providers for infrastructure delivery, and (c) legal authorities when required by law.

8. Your Rights. Under GDPR, you have the right to access, rectify, erase, restrict processing, port, and object to the processing of your personal data. Contact us at [email protected] to exercise these rights.

9. Data Transfers. Your data is stored within the European Economic Area. Any transfer outside the EEA will only occur with appropriate safeguards, including Standard Contractual Clauses approved by the European Commission.

Service Execution & Client Rights

Terms of Service

1. Service Agreement. By engaging CodeFlowWorks for web design services, you enter into a binding agreement governed by these terms. All services are performed from our office at Rua da Sofia 150, 3000-389 Coimbra, Portugal.

2. Scope of Work. Each project begins with a detailed proposal outlining deliverables, timelines, and pricing. The agreed proposal constitutes the complete scope of work. Any changes beyond the original scope require a written change order.

3. Payment Terms. Projects are billed according to the agreed milestone schedule. Invoices are due within 14 days of issue. Late payments incur a 2% monthly surcharge. All prices are quoted in Euros (EUR) and are exclusive of applicable VAT.

4. Intellectual Property. Upon full payment, all final deliverables, design files, and source code are transferred to the client. CodeFlowWorks retains the right to display completed work in portfolio and case studies unless explicitly restricted in writing.

5. Client Responsibilities. Timely provision of content, feedback, and access credentials is required to maintain project timelines. Delays in client response exceeding 14 business days may result in schedule adjustments.

6. Warranties. CodeFlowWorks warrants that all deliverables will conform to the agreed specifications for a period of 30 days following final delivery. This warranty covers defects in workmanship and does not cover modifications made by the client post-delivery.

7. Limitation of Liability. CodeFlowWorks' total liability shall not exceed the total project fee paid. We are not liable for indirect, consequential, or incidental damages including lost profits, data loss, or business interruption.

8. Termination. Either party may terminate the agreement with 14 days written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date.

9. Governing Law. These terms are governed by the laws of Portugal. Any disputes shall be resolved through the courts of Coimbra, Portugal.

Cookie Policy

1. What Are Cookies. Cookies are small text files stored on your device when you visit our website. They help us understand how you interact with our site and improve your experience.

2. Essential Cookies. We use strictly necessary cookies to ensure our website functions properly. Financial Protections & Guarantees

Refund Policy

1. Milestone-Based Refunds. Projects are delivered in agreed milestones. If a milestone deliverable does not meet the specifications outlined in the project proposal, CodeFlowWorks will revise the work at no additional cost within 14 days of the feedback submission.

2. Pre-Completion Cancellation. If you cancel a project before completion, you are entitled to a refund for any milestones that have not yet been initiated. Work completed in initiated milestones is non-refundable but all deliverables produced to date will be provided.

3. Post-Delivery Disputes. Refund requests must be submitted within 30 days of final delivery. Requests are reviewed on a case-by-case basis considering the project scope, deliverables provided, and adherence to agreed specifications.

4. Non-Refundable Items. The following are non-refundable: (a) third-party licensing fees paid on your behalf, (b) domain registration or hosting setup costs, (c) custom stock photography or asset purchases, and (d) work completed under approved change orders.

5. Refund Processing. Approved refunds are processed within 14 business days to the original payment method. You will receive email notification once the refund has been initiated.

6. Dispute Resolution. In the event of a disagreement regarding refund eligibility, both parties agree to attempt resolution through direct communication. If resolution cannot be reached, disputes shall be submitted to the courts of Coimbra, Portugal.
